GIVEAWAY TERMS & CONDITIONS

1. Promoter

The promoter is Sirius Alpha Pty Ltd trading as Mocha Pom (ABN 77 951 574 612

), operating via https://mochapom.com (the Promoter).

2. Eligibility

 Entry is open to individuals who:

• Are Australian Residents 18 years of age or older at the time of entry
• Have a valid email address
• Meet any location requirements stated in the giveaway announcement (for example, Australia only or worldwide)

Employees, contractors, and immediate family members of the Promoter are not eligible to enter.

3. Entry Method

To enter the giveaway, entrants must: 

• Complete the official giveaway entry form hosted on the Promoter’s website
• Provide a valid email address

• Disqualify any entry that does not comply with these Terms & Conditions or is suspected of fraudulent behaviour

 

10. Delivery of Prize

Prizes will be delivered:

• To the shipping address provided by the winner

 The Promoter is not responsible for:

• Incorrect or incomplete contact details
• Delays caused by postal services or third parties

 

11. Privacy & Marketing Consent

By entering the giveaway, entrants consent to:

• The collection and use of their personal information in accordance with the Promoter’s Privacy Policy
• Receiving email communications from Mocha Pom, including behind the scenes content, updates, merchandise announcements, and promotional emails

Entrants may unsubscribe at any time using the link provided in emails.

• Facebook
• TikTok
• Meta
• Shopify

By entering, participants release these platforms from any responsibility related to the giveaway.

 

13. Limitation of Liability

To the maximum extent permitted by law, the Promoter is not responsible for:

• Any loss, damage, or injury suffered as a result of entering the giveaway or accepting the prize
• Technical issues, including website outages, form errors, or email delivery failures

 Nothing in these Terms limits any rights that cannot be excluded under Australian Consumer Law.

 14. General Conditions

The Promoter reserves the right to:

• Cancel, suspend, or modify the giveaway if circumstances beyond its control arise
• Disqualify any entrant who tampers with the entry process or breaches these Terms & Conditions

The Promoter’s decision is final and no correspondence will be entered into.

15. Governing Law

These Terms & Conditions are governed by the laws of Australia, and entrants submit to the jurisdiction of Australian courts.
